Selectman, Larry DiBernardo, Michael McCulley, BettiePerreault, Chester Officer Todd Belcourt. Also present: Austin Cobb, Nicole LarsonandCraig Carrico.

The meeting was calledto order at 7:10P.M.

1. 
Approval of 12.02.2009 and 01.06.2010 Minutes: 
a. 
OnmotionbyMr.DiBernardo,secondedbyMs.Perreault,theminutesoftheDecember2,2009meetingwereunanimouslyapproved. 
Thevotewas: Thevote was: IN FAVOR: DiBernardoand Perreault. OPPOSED: None.
b. 
On motion by Mr. McCulley, seconded by Ms. Perreault, the minutes oftheJanuary 6, 2010 meeting were unanimously approved. The vote was: Thevote was: IN FAVOR: McCulleyand Perreault. OPPOSED: None.
2. 
Requests to reopen thereview of citations:
a. 
Austin Cobb: Mr. Marsh reviewed the Citation issued to Mr. Cobb and theproceedings of the January 6, 2010 meeting concerning Citation #048.OfficerBelcourtreviewedtheCitationandthereasonithadbeenissued. Mr.McCulley noted thatatthe January meetingMr.Cobb had indicated that hefelttherehadbeenwhathereferredtoas“profiling”byOfficerBelcourtandpointedoutthatatthetimetheCitationhadbeenissued(21.36hours,9:36PM),itwouldhavebeendarkandvisibilitylimited. Mr.Cobbreiteratedhisbelief that because he drives a modified vehicle with a louder-than-normalexhaustsystemwhichhasbeenDMVcertifiedaslegal,theofficerwouldhaveclearly recognized thatfact when he passed the officer’s vehicle, and couldalsohaveseenhimatthattime. HequestionedOfficerBelcourtaboutradarcapabilitiesandvariousquestionshesaidhadbeenaskedby 
theofficerafterhestoppedhim. OfficerBelcourtrespondedthathewasonl 
doinghisjobasa Chester police officer. Mr. McCulley pointed out that this Board can onlymakeadecisionconcerningtheCitationthatwasissued;thattheTownhastrainedofficersandMr.Cobbwaschallengingtheofficerinquestioninthisdiscussion. 
Officer Belcourt stated he felt Mr. Cobb’s allegations wereinsulting to 
his integrity. Mr. Marsh reiterated that the Citation is the onlymatter under consideration and that while Mr. Cobb may be implying hisbelief thatthe officermay not be telling the truth, he cannot question thevalidityoftheCitationunlesshehascompellingreasonsandevidencethat ecouldnothavebeentheonetowhomtheCitatioshouldhavebeenissued.

Mr. DiBernardo summarized and concurred with the remarks made by other members of the Board.

Based on the discussion, on motion by Mr. McCulley, seconded by Mr.DiBernardo,Citation #048 issued to Austin Cobb remains as issued. The votewas: IN FAVOR: DiBernardo, McCulley and Perreault.  OPPOSED:  None. 

b. 
PaulSchipritt:  Mr.Schipritt was notin attendance. OfficerBelcourt advised the Town 
had been notified thathe would not be appealingCitation #069 and would be payingthe appropriate fine.
 
3. 
Request to review citations:
a. 
Peter Kehayias:  Mr. Kehayias was notin attendanceand no action was taken on Citation #096 issued to him. Barring further communication from Mr. Kehayias, applicable fines, penalties, costs and fees will become due andpayable.
b. 
NicoleLarson:  Ms.Larson advisedthatthe nightin question road conditions 
had been icy and that because of this she had not been able tereferred to 
Officer Belcourt said there is an on-going problem with what hofully stop. 
as“roll and go” at this particular intersection. He pointed outthedifferences 
between aTown Citation anda State trafficticket. Mr.DiBernardo asked if,at the time she was stopped, Ms. Larson had explained to the officer her concern about road conditions. She respondedthatshehad not,that she had been“flustered” and upset.  Mr. McCulleyaskedif she wasindisagreement 
withthe officer,towhichsherespondedthatsheknewthatshehad notfullystopped. Mr. Marsh explained theTown has experienced a high incidence ofspeeding and other traffic violations with traffic being rerouted 
throughtown as a result of constructionactivities and that there areserious safety concerns. Mr. McCulley moved that based on the 
discussion and 
heracknowledgmentthat she had not come to a full stop, Citation #106 issued toNicoleE.Larson remains asissued.  Ms.Perreault secondedthemotion. The vote was: IN FAVOR: DiBernardo, McCulley and Perreault.  OPPOSED:  None.
 
c. 
CraigCarrico:  Mr.Carrico advised ashehad approached MapleStreetfromDeep River he saw a reflectioninthe woods tothe west side of MapleStreetandthughtitmighthavebeen a motorcyclethathad goneoffthe road.  He 
explainedthat after he turned onto Maple Street he continued to think there might be something there, and started to back up to check further. When 
OfficerBelcourt approached him,he saidhe asked the officer 
to check the 
situation.  Mr. DiBernardo asked if he had, in fact come to a complete stop.Mr.Carricoresponded, “Maybenot, but I did come 
to a ‘reasonable stop’“

consideringthe time ofevening andlack oftraffic. Officer Belcourt provided 
a detailed diagram showing thepositions ofhis vehicle, Mr. Carrico’s vehicle and the bicycle allegedly causing 
the reflections cited by Mr. Carrico.  He 
statedthathedid notobserve Mr.Carrico stopuntilafterhewasthrough the intersection 
and 
on Maple Street. Mr. DiBernardo explained 
this Board cannot lower fines orchange the conditions ofa Citationand that since Mr. Carricoapparently was not sure 
hehad,infact, cometo a complete stop, itwouldbedifficult notto allowtheCitationtoremain asissued.  Based onthediscussion,on motionby Mr.DiBernardo, secondedby Mr. McCulley, Citation 
#056 issued to Craig D.Carrico remains as issued. Thevote was: INFAVOR:DiBernardo, McCulley and Perreault.  OPPOSED: None.
